ILG Legal is proud to announce a significant win in the Superior Court of California, Santa Clara County, which has granted our motion to lift the stay on discovery in the ongoing case of Andrew Mo vs. Samsung Research America, Inc. This decision marks a critical milestone in the employment law case against the tech giant.

Andrew Mo, a former Senior Director of Software at Samsung, reported discriminatory behavior within the company, only to be terminated in retaliation. ILG Legal took on his case and brought claims for unlawful retaliation, wrongful termination, and discrimination and harassment against one of the world’s largest tech companies.

The case’s complexity increased when Samsung sought to compel the case to arbitration, citing a clause in the employment agreement. However, the Court, after careful consideration, denied Samsung’s motion to compel arbitration, emphasizing that the agreement, as part of the employment terms, mandated adherence to California law—not just in the narrow scope of arbitration but in a broader interpretative context.

This denial was subsequently appealed by Samsung, leading to a stay of proceedings. However, the California legislature’s recent amendment to the Code of Civil Procedure section 1294(a) has shifted the legal landscape. This amendment was designed to prevent corporations from using appeals as a stalling tactic, thereby enabling cases to proceed without an unnecessary delay. The Court’s latest order cites this new legal framework, allowing discovery to continue despite the ongoing appeal.
